1. Agreement to Terms

Welcome to Comic Translate ("Service", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the Comic Translate website located at comic-translate.com and all related services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these Terms, you may not access the Service.

We reserve the right to update these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

2. Eligibility

If we discover that you are under 18 years of age, we reserve the right to terminate your account and delete your information.

• Use another person's account without permission
• Create an account using false or misleading information

4. Description of Service

Comic Translate provides text recognition and translation services for comic books and similar visual content. Our Service:

• Accepts image uploads from users
• Processes images using third-party AI service providers and/or our own models
• Returns processed text recognition and translation results to users
• Manages user subscriptions and credit systems

5. Credits, Subscriptions, and Payments

5.1 Credit System

Our Service operates on a credit-based system. Each text recognition or translation request consumes credits from your account balance. Credit costs may vary based on:

• The service provider you select
• The complexity of the request
• Your subscription tier

5.2 Subscription Plans

We offer subscription plans that provide credit allocations. Credits may expire as specified in your subscription terms. Subscriptions automatically renew unless cancelled.

5.3 Payments

• All payments are processed through Stripe
• Prices are stated in USD unless otherwise specified
• You authorize us to charge your payment method for all fees
• Failed payments may result in service suspension

5.4 Cancellation

You may cancel your subscription at any time through your account settings or the Stripe customer portal. Upon cancellation:

• You will retain access to your subscription benefits until the end of your current billing period
• Your subscription will not renew
• Unused subscription credits will be forfeited at the end of the billing period
• One-time credit packs remain in your account

6. Refund Policy

6.1 Refund Policy

Refunds for subscription payments and one-time credit packs are handled at our sole discretion and will be evaluated on a case-by-case basis.

7. Acceptable Use Policy

7.1 Prohibited Content

You agree not to upload, transmit, or process content that:

• Contains child sexual abuse material (CSAM) or child exploitation content
• Violates any applicable law or regulation
• Infringes on intellectual property rights of others
• Contains viruses, malware, or other harmful code
• Is designed to harass, abuse, or harm others
• Violates the content policies of our third-party service providers

7.2 Content Moderation

We employ content moderation systems to detect and block prohibited content. Content that violates our policies or third-party provider policies may be rejected. We reserve the right to take appropriate action including but not limited to refusing to process content, suspending or terminating accounts, and reporting illegal content to authorities as required by law.

7.3 Service Provider Policies

When you select a specific service provider, your content must comply with that provider's usage policies. Violations may result in request rejection, service restrictions, or other limitations deemed necessary.

7.4 Prohibited Activities

You agree not to:

• Attempt to circumvent credit limits or payment systems
• Reverse engineer or attempt to extract our proprietary code
• Use automated systems to scrape or download content
• Interfere with or disrupt the Service or servers
• Use the Service for any unauthorized commercial purpose
• Resell or redistribute our services without permission

8. Intellectual Property Rights

We do not claim ownership of any content you upload or any results generated through our Service. You are solely responsible for ensuring you have the rights to any content you upload.

The Service itself, including its features and functionality, is owned by Comic Translate and is protected by applicable intellectual property laws.

9. Third-Party Services and Links

Our Service integrates with and relies on third-party service providers (including AI model providers, cloud infrastructure, and payment processors). These providers have their own terms of service and privacy policies. We are not responsible for:

• The availability or performance of third-party services
• The accuracy or quality of results from third-party services
• Data handling practices of third-party providers
• Changes to third-party service terms or pricing
• Content of third-party websites linked from our Service

10. Disclaimers and Limitations of Liability

10.1 Service "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 No Warranty

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from the Service will be accurate or reliable

10.3 Translation Accuracy

Comic Translate is a tool to assist with translation, but we make no guarantees about the accuracy, completeness, or quality of translations. Results depend entirely on third-party AI services. You are responsible for reviewing and verifying all translations.

10.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMIC TRANSLATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Termination

11.1 By You

You may terminate your account at any time by contacting us at support@comic-translate.com. Upon termination, your right to use the Service ceases immediately.

11.2 By Us

We may terminate or suspend your account immediately, without prior notice, if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• Your account poses a security risk
• You fail to pay fees owed
• We are required to do so by law

11.3 Effect of Termination

Upon termination:

• Your right to use the Service ceases immediately
• We will delete your account data within a reasonable timeframe (subject to legal retention requirements)
• Unused credits will be forfeited (no refunds unless required by law)
• All provisions of these Terms that should reasonably survive termination shall survive

12. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials. This includes failures or disruptions in third-party services (including AI providers, cloud infrastructure, payment processors, or other service providers) that we rely upon to deliver the Service.

13. Changes to Service and Terms

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Dispute Resolution and Arbitration

14.1 Informal Resolution

Before filing a claim, you agree to contact us at support@comic-translate.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute informally by contacting you via email.

14.2 Binding Arbitration

If we cannot resolve the dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration shall be conducted by a single arbitrator and shall be governed by the applicable rules of the arbitration forum chosen by mutual agreement of the parties.

14.3 Class Action Waiver

YOU AND COMIC TRANSLATE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Comic Translate agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

14.4 Exceptions to Arbitration

Either party may seek equitable relief in court for infringement or other misuse of intellectual property rights.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Comic Translate regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

15.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

15.5 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law principles.
